End-User License Agreement

By installing or using AlphaUpscale you agree to these terms.

1. License

With an active subscription, Odyssean LLC grants you a non-exclusive, non-transferable license to install and use AlphaUpscale for personal or business use, including preparing images you sell, on up to 3 computers you use yourself, identified by your license key. The software is licensed, not sold.

2. Free images

Before buying, you may process 20 images free. The trial is full-featured and requires no AlphaUpscale account or license check; it is counted on your computer. After the 20 images the app keeps working with everything you made, and asks for a key before it makes new files.

3. Subscription, renewal, cancellation

The subscription renews monthly or annually, depending on the plan chosen at checkout, until cancelled. Cancel any time via the billing portal linked in your purchase email; the license keeps working until the end of the period already paid for. If a renewal payment fails and is not resolved, the license stops validating after a grace period.

4. Refunds

If AlphaUpscale isn't working out within the first 14 days after purchase, email team@alphaupscale.com for a full refund, no questions asked.

5. Your images and the files you make

You keep all rights to the images you open in AlphaUpscale and to the files it makes from them. We receive none of them. You are responsible for having the rights to the images you process and sell, and for the accuracy of what you tell your buyers, including any disclosure a marketplace requires for AI-generated art.

6. What you may not do

• Share, publish, resell, or sublicense your license key, or use one key across more people than yourself.
• Redistribute, rent, or provide the software as a service to third parties.
• Reverse-engineer, decompile, or modify the software or its licensing mechanism, except where law expressly permits.

7. Updates and third-party components

Updates are delivered automatically while your subscription is active. The software includes open-source components, including the Real-ESRGAN models (BSD 3-Clause), Real-ESRGAN-ncnn-vulkan (MIT), ncnn (BSD 3-Clause), the IS-Net background-removal model (Apache 2.0), ONNX Runtime (MIT), cryptography (Apache 2.0 / BSD), Pillow and Python, whose license texts accompany the installed application.

8. Results disclaimer

AI upscaling creates detail that was not in the original image, and background removal can cut an edge in the wrong place. Check every file at full size before you sell or print it. If the graphics card cannot run the AI model, the app makes a plain enlargement and marks the file clearly; do not sell it as an AI-upscaled file.

9. Warranty and liability

The software is provided "as is", without warranties of any kind, to the maximum extent permitted by law. Odyssean LLC's total liability under this agreement is limited to the amount you paid for the software in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

10. Termination

This agreement ends if you materially breach it or when your subscription lapses; sections 5, 6, 9 and 11 survive. Upon termination you must stop using the software to make new files. Files you made with it remain yours.

11. General

This agreement is governed by the laws of the State of Washington, USA, and disputes belong to the state or federal courts located in Washington. If a provision is unenforceable, the rest stands. This is the entire agreement about the software and supersedes prior discussions. Changes to these terms will be posted at this address with an updated effective date.
